Latitude Terms of Service

1. Who we are and what these terms cover
Personal Content AI ("Personal Content AI," "we," "us," or "our") provides Latitude, a software product for LinkedIn content planning, drafting, scheduling, analytics, account management, and related support services. These Terms of Service ("Terms") govern your access to and use of Latitude, our websites, authenticated applications, connected account workflows, billing flows, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, starting a trial, connecting a third-party account, or purchasing a subscription, you agree to these Terms. If you use the Services on behalf of a company, client, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and account responsibilities
You must be at least 18 years old and able to form a binding contract to use the Services. You must provide accurate account, billing, and contact information and keep it current.
You are responsible for safeguarding your login credentials and for all activity under your account, workspace, or connected accounts. If you invite team members, contractors, clients, or delegates to use Latitude, you are responsible for ensuring they are authorized and that their use complies with these Terms.
You may not access or manage any LinkedIn account, organization, page, customer account, or other data through Latitude unless you have the legal and contractual right to do so.
3. Third-party services and connected accounts
Latitude integrates with third-party services, including LinkedIn for authentication, posting, and analytics workflows, and Stripe for payment processing. Your use of third-party services is governed by their own terms, policies, documentation, and platform rules. We do not control those third-party services and are not responsible for their actions, outages, policy changes, API limits, or decisions to deny, revoke, suspend, or change access.
When you connect a third-party account, you authorize Personal Content AI to access, process, store, and transmit information from that account as needed to provide the Services you request, including content drafting, scheduling, publishing, analytics, billing, support, and account management. You may be able to revoke connected account access through Latitude or through the third-party service.
You are responsible for complying with LinkedIn's user, developer, API, automation, content, and anti-spam rules when using Latitude with LinkedIn. You must not use the Services to post, schedule, collect, or process content in a way that violates LinkedIn's terms or harms LinkedIn members, accounts, or professional relationships.
4. Your content, AI outputs, and publishing decisions
You retain ownership of the content, files, prompts, account information, brand materials, analytics, and other materials you provide to Latitude ("Customer Content"). You grant Personal Content AI a limited, non-exclusive license to host, process, display, transmit, reproduce, modify, and use Customer Content as needed to provide, secure, support, maintain, and improve the Services.
Latitude may generate drafts, suggestions, captions, schedules, summaries, recommendations, analytics interpretations, and other outputs ("Outputs"). Outputs may be inaccurate, incomplete, duplicative, or unsuitable for your audience, legal obligations, brand standards, or platform requirements. You are responsible for reviewing, editing, approving, and deciding whether to publish or rely on any Output.
You are responsible for ensuring that Customer Content and any content you publish through Latitude comply with applicable law, third-party rights, professional obligations, advertising rules, employment duties, confidentiality obligations, and platform policies. We do not guarantee specific engagement, follower growth, impressions, revenue, hiring, sales, or other business outcomes.
5. Acceptable use
You may not use the Services to:
- violate any law, regulation, court order, contract, or third-party platform rule;
- infringe, misappropriate, or violate intellectual property, privacy, publicity, confidentiality, or other rights;
- misrepresent identity, affiliation, endorsement, authorization, or the source of content;
- send spam, deceptive content, phishing attempts, malware, or abusive, harassing, hateful, or unlawful material;
- scrape, harvest, or process data without the right to do so;
- interfere with, disrupt, overload, probe, scan, or compromise the security or integrity of the Services;
- reverse engineer, decompile, copy, resell, lease, sublicense, or create a competing service from Latitude except as permitted by law;
- share account credentials, bypass access controls, or use another person's account without authorization; or
- use automated means in a way that violates LinkedIn's or another third-party service's terms.
6. Trials, subscriptions, billing, and cancellation
Some Services are free, trial-based, promotional, or paid. Pricing, billing frequency, included features, trial length, renewal terms, taxes, and cancellation instructions will be disclosed in the checkout, account, order, or subscription flow that applies to your plan.
If you purchase a paid subscription, you authorize Personal Content AI and our payment processor, Stripe, to charge your payment method for recurring subscription fees, applicable taxes, usage-based charges, and other amounts disclosed to you. Unless the checkout or order flow says otherwise, subscriptions renew automatically until canceled.
You may cancel a subscription through the account or billing portal when available, or by contacting support@get-latitude.com. Cancellation stops future renewal charges but does not automatically refund charges already incurred, unless required by law or expressly stated in your plan terms. We may change prices or plan features with notice as required by law or the applicable order terms.
If payment fails, is reversed, or is overdue, we may suspend or limit access to paid features after reasonable notice where required. You are responsible for any amounts owed through the effective cancellation date.
7. Product changes, beta features, and availability
We may add, change, suspend, or discontinue features as we improve Latitude or respond to operational, security, legal, business, or third-party platform requirements. Beta, pilot, experimental, or early-access features may be incomplete, unstable, or changed without notice.
We work to keep the Services reliable, but we do not guarantee uninterrupted availability, error-free operation, specific delivery or publish times, or continued access to any third-party API or integration.
8. Security and privacy
We use administrative, technical, and organizational safeguards designed to protect the Services and Customer Content. No method of transmission or storage is completely secure, and you are responsible for using appropriate account security practices, including strong passwords and careful access management.
Our Privacy Policy explains how Personal Content AI collects, uses, and protects personal information. By using the Services, you agree that we may process information as described in the Privacy Policy.
9. Intellectual property and feedback
Personal Content AI and its licensors own the Services, including Latitude's software, interfaces, workflows, designs, documentation, trademarks, logos, and other technology and content, except for Customer Content and third-party materials. These Terms do not grant you ownership of the Services.
If you provide ideas, suggestions, feedback, or requests about the Services, you grant Personal Content AI a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.
10. Confidentiality
If either party receives non-public information from the other party that a reasonable person would understand to be confidential, the receiving party will use that information only to perform under these Terms and will protect it using reasonable care. Confidential information does not include information that is public, independently developed, rightfully received from another source, or required to be disclosed by law.
11. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access to the Services if we reasonably believe you violated these Terms, created risk for Personal Content AI, other users, third-party platforms, or the public, failed to pay amounts when due, or used the Services in a way that may expose us or others to legal, security, or operational risk.
After termination, provisions that by their nature should survive will continue to apply, including payment obligations, intellectual property rights, confidentiality, disclaimers, limitations of liability, indemnity, and dispute provisions.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Personal Content AI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, availability, security, and error-free performance.
Latitude does not provide legal, financial, employment, investment, tax, or professional advice. You should review AI-generated and human-assisted content before publishing or relying on it.
13. Limitation of liability
To the fullest extent permitted by law, Personal Content AI will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, reputational harm, platform suspension, or lost opportunities, even if we have been advised of the possibility of those damages.
To the fullest extent permitted by law, Personal Content AI's total liability for all claims relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid to Personal Content AI for the Services during the twelve months before the event giving rise to the claim, or (b) $100.
14. Indemnification
You will defend, indemnify, and hold harmless Personal Content AI, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your Customer Content, your use of the Services, your connected accounts, your published content, your violation of these Terms, your violation of law or third-party rights, or your violation of third-party platform terms.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. The parties will try to resolve disputes informally first. If a dispute cannot be resolved informally, the state and federal courts located in Massachusetts will have exclusive jurisdiction, and each party consents to venue and personal jurisdiction there, except either party may seek injunctive or equitable relief in any court with jurisdiction.
16. Changes to these terms
We may update these Terms from time to time. Material updates will be posted on this page with a new effective date or communicated through the Services when appropriate. Your continued use of the Services after updates become effective means you accept the revised Terms.
